These terms are a contract between you and the operator of Ghostedcheck. By using the site, browsing the ledger, or filing a report, you agree to these terms, the community guidelines, the privacy policy, and the legal notices. If you do not agree, do not use Ghostedcheck.
These terms limit claims and assign responsibility. They cannot stop anyone from filing a lawsuit. No website, disclaimer, or recurrence hold can. Read them anyway. They are how Ghostedcheck is offered.
Eligibility
Ghostedcheck is for adults. You must be at least 18 years old to use the site or file a report. The ledger is not directed at children under 13 and is not intended for anyone under 18. If you are under 18, leave.
What Ghostedcheck is
Ghostedcheck is a public forum for first-hand accounts of hiring processes — ghost jobs, unpaid take-homes, re-posted listings, and related patterns. It is an interactive computer service that hosts third-party speech. It is not a newsroom, not a background-check service, not a consumer reporting agency, and not a lawyer. Reports are user-generated. Only reports that meet a self-tuning recurrence hold are listed. Ghostedcheck does not investigate, endorse, or warrant that any report is true.
What Ghostedcheck is not
- Not a consumer reporting agency under the Fair Credit Reporting Act, 15 U.S.C. § 1681 et seq., or any similar state law.
- Not a verification that anyone applied, interviewed, or was hired.
- Not Ghostedcheck’s own findings about an employer.
- Not a promise that you will not be sued, that a claim will be dismissed, or that Section 230, anti-SLAPP, or any other defense will succeed in every case.
Your reports
You may file only about a process you personally went through. You must write about the company, the posting, and the process — not named people. You grant Ghostedcheck and its operator a worldwide, non-exclusive, royalty-free, sublicensable, irrevocable license to host, reproduce, display, hold, hide, moderate, and index that text on the ledger. You keep whatever rights you have in your words. Because there are no accounts, you cannot edit or delete a report after it is filed. Filing does not guarantee publication.
You represent that: you are 18 or older; the report is first-hand; it names no individual and includes no contact details; you have the right to grant the license above; to your knowledge the factual statements are true or are clearly labeled opinion; and you are not filing to harass, defame, or manipulate the ledger.
You are solely responsible
You are solely responsible for what you write. Ghostedcheck is a host, not the speaker of your report. False statements of fact about a person or a company can have legal consequences for you, including defamation claims. Naming people is blocked by automated screens, but a company can still sue over a false factual claim about the company itself. Opinion about a process you experienced is safer than an accusation you cannot prove. See the guidelines before you file. This is not legal advice.
Indemnity
You will defend, indemnify, and hold harmless Ghostedcheck, its operator, owners, affiliates, hosts, contractors, and suppliers from any claim, demand, loss, liability, or expense (including reasonable attorneys’ fees) arising out of or related to: (a) a report or other content you submit; (b) your use of the ledger; (c) your breach of these terms or the guidelines; (d) your violation of law; or (e) any claim that your content defames, infringes, invades privacy, or otherwise harms a person or a company. Ghostedcheck may participate in the defense with counsel of its choice. This duty survives your use of the site.
Platform role
Ghostedcheck is a provider of an interactive computer service. It hosts information provided by another information content provider. It is not the publisher or speaker of that information, as those terms are used in 47 U.S.C. § 230(c)(1). Automated filters, the self-tuning recurrence hold, community flags, and hiding of guideline-breaking reports are good-faith steps to restrict access to material that is obscene, lewd, lascivious, filthy, excessively violent, harassing, or otherwise objectionable, whether or not such material is constitutionally protected, as described in 47 U.S.C. § 230(c)(2). Those steps do not make Ghostedcheck the author of what remains. Section 230 is a defense. It is not a warranty that a lawsuit will fail.
Fair Credit Reporting Act
You will not use Ghostedcheck, in whole or in part, as a consumer report, investigative consumer report, or background check, and you will not use it to make employment, credit, insurance, or tenant-screening decisions about any individual, as those terms are used in the FCRA or similar state laws (including the California Investigative Consumer Reporting Agencies Act). The ledger is about companies and hiring processes, not named people, and it is still unverified.
Prohibited use
- Filing about a process you did not go through.
- Naming individuals, posting contact details, or doxxing.
- Threats, hate, copyright infringement, or other illegal content.
- Using the ledger to make employment, credit, insurance, or tenant decisions about a person.
- Scraping, flooding, or attempting to manipulate the ghost index or the recurrence hold.
- Pretending to represent Ghostedcheck.
- Using the site if you are under 18.
Moderation
Ghostedcheck may reject, hold, hide, or refuse to display content that appears to break these terms or the guidelines, including after community flags or because a pattern has not met the current recurrence threshold. The threshold is computed from ledger-wide and cluster flag and hide rates. Those steps are automated and discretionary. There is no right to have a report become or stay public, and there is no appeal form, because there are no accounts.
Company names
Reports use employer names to identify the subject of a first-hand hiring-process account (nominative fair use). Use of a company name is not an endorsement, affiliation, or statement by that company. Ghostedcheck does not currently offer a claimed profile or a paid takedown. Formal demands use the legal request package.
Disclaimers
The ledger is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. Ghostedcheck does not warrant that reports are accurate, complete, or lawful, that the service will be uninterrupted, or that a filing will become public. You use the ledger at your own risk. If you rely on a report when deciding whether to apply, that decision is yours.
Limitation of liability
To the maximum extent permitted by law, Ghostedcheck and its operator, owners, affiliates, hosts, contractors, and suppliers are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, reputational harm, or loss of goodwill, even if advised of the possibility. Total liability for any claim arising out of the service is limited to the greater of one hundred U.S. dollars (US $100) or the amount you paid Ghostedcheck in the twelve months before the claim — which is nothing. Some places do not allow certain limits; there the limit is the maximum the law allows.
Class waiver and time limit
You may bring claims only in your individual capacity. You waive any right to participate in a class, collective, consolidated, or representative action, to the extent the law allows. You must file any claim arising out of these terms or the service within one (1) year after it arose, or it is permanently barred, to the extent the law allows.
Governing law and venue
These terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Exclusive venue and jurisdiction for any dispute arising out of or relating to Ghostedcheck, these terms, a report, or the ledger is the state courts of Wichita County, Texas, or the federal courts sitting in the Northern District of Texas, Wichita Falls Division, as applicable. You consent to personal jurisdiction there. You waive any objection based on venue or forum non conveniens. The parties agree that disputes will be resolved in court, not by arbitration. If a court finds a section unenforceable, the rest still applies.
Changes; entire agreement
Ghostedcheck may update these terms. The date on this page is the current version. Continued use after a change is acceptance. Because there are no accounts, we cannot email you. These terms, with the guidelines, privacy policy, and legal notices, are the entire agreement. They supersede prior versions. Failure to enforce a provision is not a waiver. You may not assign these terms. The operator may assign them. There are no third-party beneficiaries except the indemnified parties named above.
